Send to email | What Do Wal-mart, Larry Flynt, And The Republican Party Have In Common? Griping About Cafepress.Com in General | By Silicon el 30-Aug-2008 | CafePress.com has a fairly straightforward business. Customers upload a custom graphic to the company's servers and set up an online shop to put that image on everything from T-shirts to coffee mugs. CafePress and the designer split the proceeds.
But that same simple business model makes CafePress a magnet for claims filed by brands, businesses and other intellectual property owners who think someone's ripping them off. But it turns out it's a lot tougher to get things off the site than just sending an angry legal letter -- or even filing a lawsuit. Some greatest hits:
Wal-Mart Vs. Charles Smith:
Wal-mart demands critic Charles Smith and CafePress cease and desist from selling Smith's "Wal-Qaeda" and "Wal-ocaust" designs in December 2005. Smith wins in court in March 2008 when a judge rules "Smith's parodic work is considered noncommercial speech and therefore not subject to Wal-Mart's trademark dilution claims."

Larry Flynt Publications, publisher of HUSTLER magazine, sues CafePress for hosting designs that allegedly violate the HUSTLER trademark. CafePress and Flynt reached an "amicable resolution" in June 2008: CafePress agrees to remove some "Hustler" designs from the site, but others, like the one below, remain for sale.

In February 2008, the Republican National Committee demands that CafePress cease and desist from hosting designs that use the terms 'GOP,' 'Grand Old Party,' 'Republican National Committee,' 'RNC,' as well as elephant designs. CafePress and the Republicans reached an interim agreement in July.
We're calling this one a win for CafePress. The site agreed to send a notice to users using the term "GOP" or the elephant symbol they should contact the RNC to obtain a license. But, the site "reserves all of its rights in the event that our shopkeepers have problems obtaining licenses to use the RNC's trademarks," setting the stage for more legal wrangling. We somehow doubt the design on the right, still on sale on CafePress (click the image to visit the store), will receive the RNC's blessing.
